Will Ted Nugent Support/Publicize My Second Amendment Case?

DISCLOSURE: Because I have pushed my Second Amendment case for the last 8 years and because every Second Amendment advocacy group has declined to even acknowledge the existence of my Second Amendment case for National Open Carry from a U.S. merchant seaman’s point of view let alone support my case with funding and legal assistance I have adopted a cynic’s critical view of those who publicly profess their advocacy for the Second Amendment. I now take aim at Ted Nugent.

My newest Second Amendment lawsuit, (Admiralty/Maritime civil complaint) as a U.S. merchant seaman was delivered Tuesday, May 18, 2010 to the U.S. District Court for the District of Columbia by UPS (Tracking Number 1Z4AR7360339764040). Don Hamrick v. United States, Putative President Obama, Chief Justice John Roberts, John F. Clark, Director, U.S. Marshals Service, Janet Nepalitano, Secretary, Homeland Security, Admiral Thad Allen, Commandant, U.S. Coast Guard.  Second Amendment case for National Open Carry AND for arming U.S. flag vessels and U.S. crew to defend against piracy on the high seas. Contract security denies U.S. merchant seamen aboard U.S. flag vessels their Second Amendment rights and the right to armed self-defense. I am waiting to get the Case Number and the name of the assigned judge.

Ted Nugent held a book signing event May 9, 2003 for his new book, Kill It and Grill It, at Borders Books and Music in Raleigh, North Carolina. I attended that book signing event to give Ted Nugent a copy of my Petition for Writ of Certiorari (perfect-bound, official booklet form) for the U.S. Supreme Court, (No. 03-145). Ted Nugent told me he would get in touch with me. He never did contact me. Just seven months earlier Robert Dowlut, attorney for the NRA, refused my request for help from the NRA.  Every Second Amendment advocacy group I contacted for help since then, and every attorney I contacted to represent me pro bono or on contingency fee basis, everyone declined to help me with my Second Amendment lawsuit. I persued my lawsuit without help and without representation in spite of universal rejection.

My newest lawsuit achieved ripeness for a Seventh Amendment civil jury trial with the accumulated evidence of 8 years of obstructions of justice by by federal judges, U.S. Department of Justice, U.S. Marshals Service, the U.S. Coast Guard (in retaliation for naming them as defendants) in opposition to my Second Amendment case going to trial, not only to the throw-back era of National Open Carry but also for the legal precident my case would set at the local, state, national, and international level.

Our nation is at the threshhold of a political overthrow, a financial and economic collapse as we stand bedside waiting for the imminent death of our Republican Form of Government because no one will stand up for the enforcement of the Constitution of the United States, most notably the vetting of President Obama on the natural born citizen protocol for candidates for the Office of the President and the Progressives in Congress passing legislation blatantly unconstitutional such as national healthcare, and the take over of the auto industry and other industries which transforms our free market economy into a socialist economy.

Because I have filed my newest lawsuit with the U.S. District Court for the District of Columbia I contacted Ted Nugent’s people through his web site’s Contact Us web page asking once again for help, the least of which I ask is for Ted Nugent to publicly acknowledge to the media the existence of my lawsuit. The following is the exchange of emails:

See my blog,
American Common Defence Review, to download my Second Amendment lawsuit that was delivered to the U.S. District Court for Washington, DC by UPS on May 18. I am waiting for the case number and the name of the judge assigned to the case.

When Ted Nugent was at his 2003 book signing event in Raliegh, NC, I gave him a copy of my booklet appeal, Petition for Writ of Certiorari, for the U.S. Supreme Court (Second Amendment case). Ted Nugent told me he would get in touch with me. He never did.

I want to know if Ted Nugent is really a true Second Amendment patriot or if his advocacy is only for publicity purposes with no interest in helping individual Second Amendment cases.  I am calling him out!  If he is true to his proclaimed Second Amendment advocacy he will contact me personally.

I need publicity, financial help with legal costs, and an attorney qualified in Admiralty law, constitutional law, civil rights law, law of treaties, and human rights law.

Dear Mr. Hamrick:
As you may know, we received hundreds of requests for assistance–every month.
Ted gives–and gives generously–of his time and resources.  HOWEVER, much as we would love to be able to help everyone, it simply isn’t possible.
I am not certain whether it makes a difference to you, but I am attaching the charities to which we are already committed.  I hope you can understand.
Best regards,
Linda Peterson

Did you know:

Ted Nugent works hard to preserve our great outdoor heritage for future generations. To this end, Mr. Nugent has founded the non-profit Ted Nugent Kamp for Kids, organized Ted Nugent United Sportsmen of America, and works as Ambassador for Big Brothers/Big Sisters and the Pass It On Outdoor Mentors Program.  In addition, Ted regularly hosts hunts for sick and terminally ill children through Hunt of a Lifetime, Hunt for a Cure, and the Make a Wish program.

With regard to the military, the Nugents have established the Freedom’s  Angels Foundation, which provides assistance to our brave troops. In conjunction with the Foundation, the Nugents have appeared at military bases across the nation, and are working directly with Fort Hood & the Brook Army Medical Center (particularly the Amputee Care Unit) to assist their fellow Texans. We are also working in conjunction with the Coalition to Salute American Heroes, Wounded Warriors, the Fallen Heroes Foundation and more!

As you may know, Ted was proud to tour the Middle East with Toby Keith and the USO. And we are honored to have provided more than 3200 tickets and backstage passes to individual soldiers at Ted’s performances throughout Europe and the USA during our 2005-2008 Concert Tours. Further, we have shipped thousands of CD’s, DVD’s and individual care packages containing personal notes from Ted, Nuge Java coffee, bumper stickers, guitar picks and more over the last several months.  We have also kicked off our Guitars for the Sandbox program, shipping autographed instruments overseas.

Ted is preparing for his International Trample the Weak, Hurdle the Dead Tour, and another USO tour is being discussed.

Rest assured, we are on the same page and will continue to do our part…

Thank you for your reply.

My blog, American Common Defence Review.

[PARAGRAPH EDITED FROM EMAILED VERSION] Please consider the tone of my request from my perspective. I have pushed my Second Amendment case for 8 years now (since 2002). Because I have been pushing and continue to push for National Open Carry Handgun from a U.S. merchant seaman’s point of view which is part of the “full scope” of Second Amendment rights that the federal courts have refused to address it is politically incorrect and for that I am ignored. Because of the culture of appeasement of Second Amendment advocacy groups to the gun control camp our Ninth Amendment right to National Open Carry in intrastate and interstate travel is taken from us. Because my case for National Open Carry conflicts with the NRA’s National Reciprocity for Concealed Carry the NRA refused my 2002 request for help. Not a single Second Amendment advocacy group, not the SAF, KABA, JPFO, SAS, none of them would publicly support my Second Amendment case simply because my Second Amendment case approaches the constitutional limits of the Second Amendment. This fear in Second Amendment advocacy groups to support National Open Carry is symptomatic of culture of appeasement to the gun control camp.

Ted Nugent Corporation not committing themselves to funding my Second Amendment case without notifying Ted Nugent personally is one thing. I don’t mind that. I’m used to it after having pushed my case for 8 years as an unrepresented civil plaintiff with no help from anyone. But not providing Ted Nugent a copy of my lawsuit so that he can decide for himself on at least giving him the opportunity and the right to decide for himself whether or not he wants to talk about my case to the media would not cost the corporation anything (to my knowledge anyway).

ON THAT BASIS, I request that you reconsider your prematurely preemptive rejection of my request and place it in the hands of Ted Nugent himself. He has the right to decide for himself on what to do about the existence of my Second Amendment case.

ADVISORY: I will post this exchange of emails on my blog to generate publicity for myself.

 Thank you for your reconsideration.

 Signed: Don Hamrick

I am a U.S. citizen. I am not a prohibited person from owning or possessing firearms. I am a U.S. merchant seaman whose occupation includes intrastate, interstate, international and maritime travel. It is unconstitutional to deny law-abiding U.S. citizens their Ninth Amendment right to travel intrastate and interstate under the Common Defence clause of the Preamble to the Constitution and the Second Amendment right to openly keep and bear arms. Personal and political fear of this Ninth Amendment right is no basis to prohibit that right. My lawsuit has evidence proving that prohibiting that right fuels violent crime.

Who among you, Second Amendment advocacy groups and private individuals alike, will stand with me in support of my Second Amendment case? The first step to support my Second Amendment case is to acknowledge its existence to the media. Then funding and legal assistance should follow with the raise of public awareness.

Will Ted Nugent acknowledge the existence of my Second Amendment case?

Will he help fund my case? Or am I asking too much of Ted Nugent?
