The U.S. Coast Guard operates under the U.S. Department of Homeland Security. The U.S. Coast Guard’s Merchant Marine Personnel Advisory Committee (MERPAC) was first established in 1992 at the request of the Commandant, U.S. Coast Guard. MERPAC’s purpose is to advise the Secretary of the Department of Homeland Security (DHS), via the Commandant, U.S. Coast Guard, on matters relating to the training, qualification, licensing, certification and fitness of seamen in the merchant marine. The Committee acts in an advisory capacity in accordance with 5 U.S.C. App. I (1976), the Federal Advisory Committee Act.
I attended the U.S. Coast Guard’s April 16-17, 2009 public meeting of the Merchant Marine Personnel Advisory Committee (MERPAC) held at the Massachusetts Maritime Academy. I wanted to speak about Second Amendment rights of American seamen.
April 16, 2009, I emailed all 19 members of that committee information on my ongoing litigation for Second Amendment rights of seamen and my own rights because it was not a day for the visiting public to speak to the Committee.
April 17, 2009, Capt. Joe Murphy with a Mass. Maritime Academy Police Officer and Rear Admiral Rick Gurnon, president of the Massachusetts Maritime Academy, escorted me to an empty room to question me on suspicion that I had a gun in my possession simply because I sent the committee an email or two on Second Amendment rights. This reprehensible unconstitutional behavior of interrogation simply for exercising my First Amendment right of free speech is reflective of the U.S. Department of Homeland Security’s controversial Report on Rightwing Extremism. There suspicion was that I had a gun on the compass of the Mass. Maritime Academy. This is the social/political xenophobia I am combating with my Admiralty lawsuit. Gun-Free Zones such as Mass. Maritime Academy and college campus all across America are vulnerable targets for the criminal and terrorists alike. Even aboard ship. Somalia recently adopted Sharia Law. Do we need any more warnings than that?
Capt. Joe Murphy of Mass. Maritime Academy is the father of Capt. Shame Murphy of the M/V MAERSK ALABAMA who was held hostage by Somali pirates and those pirates were shot dead by U.S. Navy Seals.
