I’m Doing What the NRA Can Only Dream About!

I am using the civil RICO Act in defense of the Second Amendment against the United States Government and against the United Nations!

Because I am a U.S. Merchant Seaman I have the distinct advantage over the NRA because not only can I attack State and Federal gun control laws but I can use federal laws and regulations against the U.S. Government and international human rights conventions and declarations against both the U.S. Government and the the United Nations! The link at right is my Addendum to my Objection to the United Nations letter they mailed to the U.S. District Court in Little Rock, Arkansas. The NRA should have used the methods describe in the Addendum and my original objection (see below) long before I discovered them on my own.

The next court document I filed was my “Emergency Motion to Deny the Motion to Dismiss” in response to the Virginia Tech Massacre. In this Motion I am prompting the U.S. Department of Justice to abandon defense of my case under the Adversarial System of Justice and proceed to trial under the Collaborative System of Justice as authorized in Rule 16(c)(9) and (12) of the Federal Rules of Civil Procedure, and as authorized by the Title 4, Section 3.100 of the U.S. Attorney’s Manual’s civil section, and as authorized by federal laws and regulations. My Disclosure Notice and Negotiated Rulemaking Demand

Homeland Security finally acknowledging my case with a “promise” to investigate my claims in response to my Disclosure Notice and Negotiated Rulemaking Demand. This is available at the link at right.

In that Disclosure, pages 7-14, are telephone numbers of government employees of the varous departments of the U.S. Government. The U.S. Department of State, U.S. Department of Justice, U.S. Department of Homeland Security, the U.S. Coast Guard, the Marine Safety and Security Council of the Coast Guard, BATFE, U.S. Department of Labor, and OSHA!, U.S. Department of Transportation, U.S. Department of Education, the President Bush’s pet project: Center for Faith-Based and Community Initiatives, National Labor Relations Board, and a few from the U.S. Congress.

Now if millions of gun owning Americans found out about my Disclosure & Negotiated Rulemaking Demand document they would have the means (pages 7-14) to call these government employees to bring them up to date on my Second Amendmnt case and to tell them how they felt would help my case immensely.

United Nations Attacking 2nd Amendment under Privileges & Immunites

I have the United Nations on official record of claiming privileges and immunities on why they cannot appear in the U.S. District Court in Little Rock, Arkansas to answer allegations from a U.S. citizen that the United Nations is waging a War of Aggression against our Second Amendment. To my knowledge this is the first time a U.S. citizen has tried to take the United States -AND- the United Nations to court in a U.S. District Court -AND- in the Inter-American Court of Human Rights in Costa Rica through the Inter-American Commisson on Human Rights in Washington, DC.

If you feel that I am on the right track with my Second Amendment case please tell the NRA and the Second Amendment Foundation.

The Motion to Dismiss my case against the U.S. Government is still pending. However, the Court did issue the Final Scheduling Order setting deadlines and setting the trial date for November 13, 2007. The deadline for the jury instructions is October 29, 2007.

Does anyone want to notify the NRA and the Second Amendment Foundation of these events? They won’t take my calls.

Now here is a surprise for you. The federal law, 28 U.S.C. ยง 1916, allows a U.S. Merchant Seaman to file cases without paying filing fees and court costs. The U.S. District Court for DC and Charolotte, NC were okay with this. But the U.S. Court of Appeals, the U.S. Supreme Court, and now the U.S. District Court in Little Rock, Arkansas have forced me to pay because I did not want to, nor did I have to, file in forma pauperis papers as a condition. I have been made to pay $1,765 in filing fees these past 4 years, 8 months. I aim to get these fees back. Every remedy I have tried so far has been denied. My latest attempt is the kicker!
